Terms of Service

These Terms form a binding agreement governing your access to Jobsite Stays and its provider-paid furnished-housing advertising directory.

1. Agreement and eligibility

These Terms of Service are a binding agreement between you and McCrohan Supply, LLC ("Jobsite Stays," "we," "us," or "our"). "You" means the person accessing or using the website at jobsitestays.com and, when applicable, the business or organization on whose behalf that person acts.

By accessing or using the website, submitting information, contacting a provider, or purchasing a listing subscription, you accept these Terms and our Privacy Policy. Providers also accept the Housing Provider Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and legally capable of entering a binding agreement. If you use the Service for an organization, you represent that you have authority to bind it. You may use the Service only within the United States and in compliance with applicable law.

2. The Service

"Service" means the Jobsite Stays website, searchable directory, listing-submission tools, housing-request and contact forms, billing-management features, editorial materials, and related communications. A "Provider" is an independent owner, operator, landlord, hotel, apartment community, RV park, property manager, or other person advertising housing. A "Housing Seeker" is a person or organization searching for or inquiring about housing.

We may offer additional features governed by supplemental terms presented with those features. If supplemental terms conflict with these Terms, the supplemental terms control for that feature.

3. Advertising directory only

Jobsite Stays sells digital advertising space and provides search and information tools. We are not a real-estate broker, leasing agent, apartment locator, property manager, travel agent, insurer, escrow service, money transmitter, debt collector, credit-reporting agency, employer, or fiduciary. We do not own or operate advertised properties unless a listing expressly says otherwise.

We do not negotiate rent or lease terms, accept rental applications, conduct tenant or provider screening, prepare or execute leases, collect rent or security deposits, hold funds for a rental, make lending decisions, guarantee payment, provide insurance, or receive compensation contingent on a rental transaction. A listing fee pays for advertising exposure only.

4. Independent listings and third-party information

Listings, photos, rates, availability, amenities, addresses, descriptions, policies, reviews, links, and provider statements come from independent providers or other third parties. They may be incomplete, outdated, inaccurate, misleading, or unavailable. Publication, administrative review, a badge, search placement, or removal of another listing does not mean we inspected, verified, certified, licensed, background-checked, endorsed, approved, or guaranteed any provider, person, property, representation, or transaction.

We have no duty to monitor every listing or communication and cannot guarantee prompt removal of objectionable or inaccurate material. Third-party statements belong to their authors and do not necessarily reflect our views.

5. Housing-seeker due diligence and safety

You are solely responsible for investigating a provider and property before relying on a listing, sharing sensitive information, signing an agreement, entering a property, or sending money. At a minimum, independently confirm:

  • The provider's identity, ownership or management authority, and reliable contact information.
  • The property's existence, exact location, condition, habitability, safety, accessibility, lawful use, and current availability.
  • All rent, taxes, deposits, fees, utilities, cancellation and refund rules, screening criteria, insurance requirements, and written agreement terms.
  • That payment instructions are legitimate. Do not send funds through irreversible or unusual methods when identity, authority, or property access cannot be confirmed.

Jobsite Stays is not an emergency service. Contact local emergency services or appropriate authorities for immediate threats, suspected crime, unsafe conditions, or emergencies.

6. Direct transactions, assumption of risk, and release

Providers and Housing Seekers communicate and transact directly. They alone are responsible for inquiries, screening, negotiations, applications, agreements, payments, deposits, taxes, refunds, cancellations, occupancy, maintenance, injuries, damage, disputes, and legal compliance. Jobsite Stays is not a party to, beneficiary of, or guarantor of those dealings and has no duty to mediate them.

To the fullest extent permitted by law, you assume the risks of dealing with other users and release Jobsite Stays and its owners, officers, employees, contractors, agents, affiliates, successors, and service providers from claims arising from or related to a provider, Housing Seeker, property, listing, communication, visit, rental, payment, injury, loss, or dispute between users. This release includes unknown claims to the extent permitted by law, including rights that would otherwise limit a release to claims known when the release is given.

7. Fair housing and legal compliance

Users must comply with the federal Fair Housing Act and all applicable state and local nondiscrimination laws. You may not publish or act on an unlawful preference, limitation, or discrimination based on race, color, religion, national origin, sex, disability, familial status, or any other protected characteristic. Legitimate occupancy standards and property policies must be applied lawfully and consistently. Report potentially discriminatory content through the contact page.

8. Acceptable use and prohibited activity

You may not:

  • Submit false, deceptive, outdated, discriminatory, infringing, defamatory, illegal, or unauthorized information.
  • Impersonate another person, misrepresent authority, advertise a property without authority, or use the Service to facilitate fraud, unlawful housing practices, trafficking, exploitation, or other illegal activity.
  • Scrape, crawl, harvest, copy, download, index, aggregate, resell, republish, or create a competing database from listings, photos, contact details, search results, or other site content, whether manually or through bots, scripts, browser automation, artificial intelligence, or machine-learning tools.
  • Use site content or user information to train or improve an artificial-intelligence model, build profiles, send bulk solicitations, spam users, or make eligibility, credit, employment, insurance, or other legally significant decisions.
  • Probe security, bypass access controls, interfere with operation, introduce malicious code, overload infrastructure, manipulate rankings or analytics, obscure attribution, or access nonpublic systems or data without authorization.
  • Use Jobsite Stays names, marks, layout, or content in a way that suggests sponsorship, endorsement, partnership, or affiliation without written permission.

We may use technical and legal measures to prevent or stop prohibited activity. Unauthorized access or use may cause irreparable harm for which monetary damages are inadequate.

9. Provider listings, subscriptions, and billing

Provider eligibility, listing duties, annual prices, automatic renewal, cancellation, refunds, content rights, and publication rules are governed by the Housing Provider Terms, the Pricing page, and the terms shown at Stripe Checkout. Each property or qualifying physical location has its own subscription. Jobsite Stays does not charge a booking commission or take a percentage of rent.

Payment does not guarantee approval, publication, search position, traffic, leads, occupancy, revenue, or any result. A paid submission remains private until approved and published. Removal from public view does not by itself cancel renewal. Providers must cancel through Manage Listing & Billing.

10. User content, feedback, and intellectual property

You retain ownership of content you submit. You grant Jobsite Stays a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, format, edit for clarity or technical compatibility, display, distribute, index, and promote that content as reasonably needed to operate, secure, improve, and market the Service. For listing content, this license continues while the listing is submitted or active and for a reasonable archival, backup, legal, or promotional wind-down period afterward.

You represent that you own or have all permissions needed for submitted content; that it is accurate and lawful; and that our authorized use will not violate privacy, publicity, intellectual-property, contractual, or other rights. Do not submit confidential information through public listing fields.

Suggestions or feedback you voluntarily provide may be used without restriction or compensation. Jobsite Stays and its licensors own the website, software, design, branding, original editorial materials, compilations, and other content we create. Except for ordinary personal evaluation of housing, you may not copy or exploit them without written permission.

12. Third-party services and links

The Service may link to or depend on providers, Stripe, maps, email, telephone, hosting, storage, social platforms, and other third parties. Their services are governed by their own terms and privacy practices. We do not control or endorse them and are not responsible for their availability, security, content, charges, conduct, or handling of information. A link or integration does not create a partnership, agency, sponsorship, or warranty.

13. Electronic communications and consent records

You consent to receive agreements, disclosures, receipts, notices, renewal reminders, and service communications electronically at the contact information you provide or through the website. Electronic communications satisfy legal writing and delivery requirements to the fullest extent permitted by law. You are responsible for keeping your contact information current and retaining copies.

When you request contact by phone or text, you authorize operational communications concerning that request. Marketing communications require any separate consent required by law and may be withdrawn using the stated opt-out method. Consent records, timestamps, IP addresses, and user-agent information may be retained to document your choices.

14. Review, ranking, suspension, and enforcement

We may, but are not required to, review submissions and user activity for quality, completeness, fraud, security, and policy compliance. We may reject, reformat, correct obvious typographical errors, request changes, change search visibility, preserve evidence, disclose information when legally permitted, suspend access, or remove content at any time when we reasonably believe it violates these Terms, creates risk, receives a credible complaint, harms users or the Service, or is otherwise inappropriate.

Search order may reflect relevance, location, completeness, freshness, availability, quality, performance, and paid placement. We do not promise any ranking. We may cooperate with lawful investigations. No refund is owed when access or a listing is suspended or terminated for a violation, except where law requires otherwise.

15. Availability, changes, and termination

We may add, change, suspend, restrict, or discontinue any part of the Service; impose limits; correct errors; perform maintenance; or terminate access without guaranteeing uninterrupted, secure, or error-free operation. We are not liable for delay or failure caused by events beyond our reasonable control, including internet, hosting, utility, payment-network, labor, weather, disaster, governmental, or security events.

You may stop using the Service at any time. Ending use does not cancel a paid subscription or eliminate obligations that already arose.

16. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT EXPRESS, IMPLIED, OR STATUTORY WARRANTIES. JOBSITE STAYS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, SAFETY, HABITABILITY, AVAILABILITY, QUIET ENJOYMENT, PROVIDER IDENTITY OR AUTHORITY, TRANSACTION OUTCOME, SEARCH POSITION, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

NO ORAL OR WRITTEN INFORMATION FROM JOBSITE STAYS CREATES A WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO A DISCLAIMER APPLIES ONLY TO THE MAXIMUM EXTENT LAWFUL.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JOBSITE STAYS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SUCCESSORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES; LOST PROFITS, RENT, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; SUBSTITUTE HOUSING OR TRAVEL COSTS; BUSINESS INTERRUPTION; FRAUD OR MISCONDUCT BY USERS; PERSONAL INJURY; PROPERTY DAMAGE; OR ANY RENTAL, PAYMENT, LISTING, COMMUNICATION, OR THIRD-PARTY DISPUTE, EVEN IF ADVISED THAT SUCH DAMAGE WAS POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF ALL JOBSITE STAYS PARTIES FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE FEES YOU PAID DIRECTLY TO JOBSITE STAYS FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

THESE LIMITS APPLY REGARDLESS OF LEGAL THEORY AND ARE AN ESSENTIAL BASIS OF THE AGREEMENT. THEY DO NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

18. Indemnification

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Jobsite Stays and its owners, officers, employees, contractors, agents, affiliates, successors, licensors, and service providers from third-party claims, demands, investigations, liabilities, judgments, settlements, penalties, losses, and reasonable attorneys' fees and costs arising from or related to your content, property, communications, transaction, conduct, negligence, legal or regulatory violation, infringement, discrimination, misuse of another person's information, breach of these Terms, or dispute with another user. We may control the defense and settlement of an indemnified matter, and you will reasonably cooperate. You may not settle a claim that imposes liability or an admission on a protected party without our written consent.

19. Mandatory informal dispute process

Before filing a lawsuit or other formal proceeding, the claimant must send an individualized written notice to legal@jobsitestays.com that states the claimant's full name and contact information, the facts and legal basis of the dispute, the specific relief requested, and reasonably available supporting documents. The parties will attempt in good faith to resolve the dispute for 60 days after a complete notice is received. Completing this process is a condition precedent to formal proceedings, except when immediate temporary relief is necessary to prevent imminent and irreparable harm or when law prohibits the requirement.

20. Governing law and exclusive venue

Texas law governs these Terms and every dispute arising from or related to the Service, without regard to conflict-of-law rules. Subject to Section 19 and except where applicable law requires another forum, any court proceeding must be brought exclusively in the state courts located in Taylor County, Texas, or the federal court with jurisdiction over Taylor County, Texas. You consent to personal jurisdiction and venue there and waive objections based on inconvenient forum.

Jobsite Stays may seek temporary, preliminary, or permanent injunctive or equitable relief in any court with jurisdiction to protect intellectual property, confidential information, data, users, or Service integrity; prevent fraud or unauthorized access; or enforce use restrictions, without waiving other rights and without posting bond to the extent permitted by law.

21. Jury-trial and class-action waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND JOBSITE STAYS KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY. EVERY CLAIM MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY. NEITHER PARTY MAY PARTICIPATE AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, REPRESENTATIVE, OR PRIVATE-ATTORNEY-GENERAL ACTION. CLAIMS OF DIFFERENT USERS MAY NOT BE JOINED OR CONSOLIDATED WITHOUT THE WRITTEN CONSENT OF ALL PARTIES. If this waiver is unenforceable for a particular claim, only that claim will proceed as required by law and the remaining waiver will continue to the fullest extent permitted.

22. Time limit to bring claims

TO THE FULLEST EXTENT PERMITTED BY LAW, ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS MUST BE FILED WITHIN ONE YEAR AFTER THE CLAIM ACCRUES, OR IT IS PERMANENTLY BARRED. This limit does not shorten a limitations period that applicable law prohibits the parties from shortening.

23. Changes and general terms

We may update these Terms prospectively by posting a revised effective date. We will provide additional notice of material changes when required by law. Continued use after revised Terms take effect constitutes acceptance, but material changes to paid subscriptions apply as stated in the Housing Provider Terms and applicable law.

These Terms, the Privacy Policy, the Housing Provider Terms when applicable, and terms presented for a specific feature constitute the entire agreement concerning the Service. If a provision is invalid or unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. Failure to enforce a provision is not a waiver.

You may not assign or transfer these Terms without our written consent. We may assign them in connection with a reorganization, financing, merger, acquisition, sale, or transfer of the Service. Nothing creates employment, agency, partnership, joint venture, franchise, fiduciary duty, exclusivity, or third-party beneficiary rights. Headings are for convenience only. Sections that by their nature should survive termination do survive, including content rights, releases, disclaimers, liability limits, indemnification, disputes, and general terms.
