1. Agreement and eligibility
These Housing Provider Terms govern property advertisements submitted to Jobsite Stays. By submitting a listing or purchasing a listing subscription, you agree to these Terms and the general Terms of Service. You must be at least 18, have authority to advertise the property, and have authority to authorize the payment method used.
2. Advertising service only
Jobsite Stays sells digital advertising space in a searchable housing directory. Jobsite Stays is not a real-estate broker, leasing agent, apartment locator, property manager, travel agent, escrow service, insurer, or party to any rental transaction. We do not solicit or negotiate listings as an agent, locate housing for a fee, negotiate rent or lease terms, accept rental applications, screen tenants, collect rent or deposits, prepare leases, or receive compensation contingent on a rental.
Housing seekers contact providers directly using the business contact information displayed on each advertisement. Providers independently handle every inquiry, screening decision, disclosure, rental agreement, payment, deposit, refund, cancellation, dispute, and stay.
3. Listing plans, approval, and annual charges
- First Eligible Provider Listing: 12 months of standard advertising at no charge, with no payment method collected and no automatic renewal.
- Additional Standard Properties: $149 per property per year when submitted under the same provider email after an existing eligible listing.
- Hotel, Community, or RV Park: The first eligible provider location may use the complimentary first-listing offer. Continued or additional locations are $750 per physical location per year. All units or pads at that address may be represented within the listing.
- Premier Placement: An optional paid annual visibility upgrade offered at the price displayed before checkout.
Eligibility for the public first-listing offer is determined using the provider email and prior listing history. The offer is limited to one listing per provider, business, or commonly controlled account and may not be multiplied through alternate email addresses or duplicate accounts. The free listing does not automatically convert to a paid subscription. When its term ends, it may be removed from public search unless the provider separately elects and authorizes a paid plan.
The exact plan and charge for paid inventory or Premier placement appear before payment in Stripe Checkout. Each paid property or location creates its own subscription. Payment does not bypass administrative review. Every submission remains private, pending, inactive, and unverified until Jobsite Stays expressly approves and publishes it.
Jobsite Stays may also offer limited complimentary advertising through a private Founding Provider invitation. A valid invitation may waive charges for the stated term and listing count and may include Premier treatment. No payment method is collected, no subscription is created, and the listing does not automatically convert to a paid plan. All complimentary submissions remain subject to the same review, content, safety, and publication requirements. Complimentary access does not guarantee approval, publication, traffic, inquiries, or business results.
Listing fees buy advertising exposure only. They do not guarantee approval, publication, impressions, search rank, inquiries, bookings, occupancy, rental income, or any other result.
4. Automatic renewal and cancellation
The public first-listing offer and complimentary Founding Provider access do not renew automatically and do not create a paid subscription. Each separately authorized paid listing or Premier subscription automatically renews for another one-year term at the then-current price unless canceled before the renewal date. Before payment, you must affirmatively authorize the recurring annual charge. Stripe provides a receipt and stores the payment method. Jobsite Stays does not store complete card numbers.
Annual subscribers receive a renewal reminder at least 15 and no more than 45 days before renewal, plus any other notices required by applicable law. Material price changes are disclosed before they take effect. You may cancel online through Manage Listing & Billing. Cancellation stops future renewal and normally leaves the listing active through the paid term. Removing a listing from public search does not by itself cancel its subscription.
5. Refunds
Listing fees are nonrefundable after a listing is activated, except when required by law or expressly approved by Jobsite Stays. Canceling renewal, removing a listing, receiving fewer inquiries than expected, or leaving a paid term early does not create a prorated refund.
If Jobsite Stays permanently rejects a paid submission before first publication and does not offer a reasonable opportunity to correct it, the provider's sole remedy is a refund of the applicable listing fee. No refund is owed for fraud, prohibited content, lack of authority, attempted misuse, chargeback abuse, or a material violation of these Terms. Duplicate charges or billing errors should be reported promptly through the contact page.
6. Provider information and public contact
You authorize Jobsite Stays to publish the property information, photos, business name, business phone, business email, and website you designate for public display. Do not submit personal contact information you do not want displayed. Exact street addresses are shown only when you authorize them. Otherwise, the public location may be limited to a general area supplied by you.
7. Provider responsibilities
You are solely responsible for:
- Keeping every fact, rate, fee, photo, amenity, availability date, policy, and contact method accurate and current.
- Owning the property or holding written authority from the owner to advertise and rent it.
- Complying with licensing, registration, zoning, occupancy, lodging, tax, safety, accessibility, building, fire, and short-term rental requirements in every jurisdiction where the property is located.
- Maintaining appropriate property and liability insurance.
- Conducting lawful tenant screening and providing all required disclosures.
- Protecting housing-seeker data and using it only for legitimate rental communications.
- Handling agreements, deposits, rent, taxes, refunds, disputes, maintenance, habitability, and emergencies directly.
8. Fair housing and nondiscrimination
Listings and provider conduct must comply with the federal Fair Housing Act and applicable state and local laws. You may not state or imply unlawful preferences, limitations, or discrimination based on race, color, religion, national origin, sex, disability, familial status, or any additional protected characteristic. Legitimate occupancy limits and property rules must be applied lawfully and consistently.
9. Prohibited listings and conduct
You may not advertise a property you lack authority to offer; use false, outdated, copied, deceptive, discriminatory, or unlawful content; impersonate another person; request payment through misleading methods; evade sanctions; upload malware; manipulate analytics; or use Jobsite Stays to facilitate fraud or illegal activity. You may not describe a property as inspected, verified, approved, endorsed, or guaranteed by Jobsite Stays.
10. Content license and intellectual property
You retain ownership of content you submit. You grant Jobsite Stays a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, and promote that content for operating and marketing the directory during the listing term. You represent that you own or have permission to use every submitted photo, logo, description, and other work.
11. Review, ranking, suspension, and removal
Jobsite Stays may use automated and administrative checks for completeness, fraud, policy compliance, and quality. Publication is not an inspection, verification, certification, or endorsement. We may reject, edit formatting, request changes, reduce visibility, suspend, or remove listings that violate these Terms, create risk, receive credible complaints, or harm the directory. Search order may consider relevance, completeness, recency, location, availability, quality, and paid promotional placement.
12. No exclusivity and no agency
You remain free to advertise elsewhere. Nothing creates employment, partnership, franchise, fiduciary duty, brokerage, agency, joint venture, or exclusivity between you and Jobsite Stays. You may not bind Jobsite Stays or make commitments on our behalf.
13. Disclaimers
The directory and related technology are provided “as is” and “as available.” To the fullest extent permitted by law, Jobsite Stays disclaims warranties of merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted availability, search placement, traffic, lead volume, and business results.
14. Limitation of liability
To the fullest extent permitted by law, Jobsite Stays is not liable for lost profits, lost rent, vacancy, substitute advertising, property damage, personal injury, fraud by users, housing-seeker conduct, indirect damages, or disputes arising from a rental transaction. Jobsite Stays' aggregate liability arising from or relating to a listing subscription will not exceed the greater of $100 or the listing fees you paid directly to Jobsite Stays during the 12 months before the event giving rise to the claim. These limitations are an essential basis of the agreement and do not exclude liability that cannot legally be limited.
15. Indemnification
You will defend, indemnify, and hold harmless Jobsite Stays and its operators from third-party claims, losses, penalties, and reasonable costs arising from your property, listing content, rental activity, taxes, legal compliance, infringement, discrimination, injury, damage, or violation of these Terms.
16. Changes and termination
We may update these Terms prospectively. Material subscription changes will be communicated as required by law. You may stop using the directory and cancel renewal at any time. Sections concerning payments already due, content rights, disclaimers, liability, indemnification, and disputes survive termination.
17. Disputes, governing law, and claim deadline
Sections 19 through 22 of the general Terms of Service are incorporated into these Housing Provider Terms. They require an individualized written dispute notice and 60-day informal resolution period, apply Texas law, select exclusive state or federal venue in Taylor County, Texas, waive jury trials and class, collective, consolidated, mass, representative, and private-attorney-general proceedings to the fullest extent permitted by law, and require most claims to be filed within one year after accrual. If a conflict exists, the provision that most specifically addresses a provider subscription controls.
